Job security means avoiding the manager's hot button ? Business ...

Question: ?During my yearly performance review, my manager told me that I was disrespectful and unresponsive. I asked for specific examples, but he didn?t provide any. This discussion took place in a restaurant, because our office recently closed and we are all working from home.

?When I didn?t respond to his comments, my boss went on a tirade for over thirty minutes, despite the fact that we were in a public place. He said that he will not tolerate my lack of respect any longer and that if I don?t change my attitude, I will probably be laid off when we merge with another team.

?He then said he was doing me a favor by not putting these remarks in writing. I told him I would rather have them included in my review, but he refused. Now I?m really scared, because I can?t afford to lose my job in this economy. I feel sick to my stomach and can?t sleep. What should I do?? Worried

Answer: A barrage of criticism does not constitute a performance review, so your boss?s outburst was completely inappropriate. However, if you are dependent on your paycheck, remaining employed must be your first priority. Since your office has already closed and your team is being downsized, your future security is clearly in jeopardy.

If you know exactly which behaviors push your manager?s ?disrespectful? hot button, then you must immediately stop doing those things. Consciously continuing to aggravate him would be stupid and self-destructive. But if you?re completely clueless, pick a calm moment and try to find out what?s bothering him.

For example: ?I really want to be viewed as a good employee, but I honestly don?t know what I?m doing that seems disrespectful. What could I do differently to get a better performance review next year?? Listen carefully to his answer without debating or arguing.

If your manager still fails to provide any useful advice, ask your co-workers for some feedback. If certain people get along well with him, observe them closely and adopt their approach.

Your manager didn?t want these critical comments in the official record, so he might just be blowing off steam. But since you can?t rely on that, your short-term goal should be to make any changes that will help you keep your job. Your long-term goal may be to find a better boss.

American activist returns to US after 9 months

(AP) ? A Vietnamese-American activist has returned to the United States after a 9-month detention on accusations of conspiring to overthrow the government.

Nguyen Quoc Quan smiled broadly as he was greeted by his wife and children shortly after 8 p.m. Wednesday after getting off a plane at Los Angeles International Airport.

A Foreign Ministry statement said Nguyen Quoc Quan had "confessed to his crime" and asked for leniency to be reunited with his family.

He was arrested in April and released Wednesday before being deported to the U.S. Authorities originally accused him of terrorism but later downgraded the charges to subversion.

The United States has been calling on Vietnam to release Quan, 59, who supporters say is a nonviolent advocate of democratic reforms in Vietnam.

Twitter cleans up Vine's hashtags, censors #porn, #sex, and other naughty terms

According to the folks at Twitter, an innocent "human error" was to blame when a pornographic video was featured as an "Editor's Pick" on Vine, but this incident?? combined with a?lack of privacy and abuse prevention controls?? makes it seem as if there's a bit of a porn problem on the new?video-sharing service.

The sudden censorship of certain hashtags further solidifies that belief.

The Verge's Nathan Ingraham was among the first to point out that it appears that the searches for certain naughty hashtags ??such as #porn, #sex, #booty?and similar ??are bringing up no results, even though there are certainly posts with those hashtags.?

I tested this claim by creating a post and tagging it #nsfw. Nothing prevented me from creating this post?? which was entirely innocent, don't worry?? but neither tapping on the hyperlinked hashtag nor searching for #nsfw brought it (or any other posts) into view. Instead, I was shown a frowning emoticon and told that Vine couldn't load any posts. (In the case of searches, the frowning emoticon informed me that no tags matching that term?exist.)?

We have reached out to Twitter to inquire about the missing search results and to see if some sort of cleanup is occurring behind the scenes.?"We're in the process of changing how users find and view sensitive content," a spokesperson explained. "We're experimenting with a number of approaches and will continue to iterate."

Common genetic alteration found in head and neck cancers may not be key to effective treatment

Jan. 29, 2013 ? Although a large majority of head and neck cancers have a deregulation of the PI3K/AKT/mTOR pathway, data recently published in Cancer Research, a journal of the American Association for Cancer Research, indicated that deregulation of this pathway does not necessarily signify that the tumor is dependent on it for survival and progression.

Cancer, particularly of the head and neck, is highly heterogeneous, with a large number of genetic alterations rendering it resistant to specific targeted treatments. Because cancer is linked to genetic abnormalities, genomic and proteomic biomarkers are currently being used to design targeted therapeutic intervention for a variety of cancer indications.

Research has shown the PI3K/AKT/mTOR pathway is deregulated in a large majority of solid tumors. Treatment with mTOR inhibitors results in robust activity in certain cancer cell lines, but they are not effective in all patients. Researchers are currently using biomarkers to try to stratify patients for response to mTOR inhibitors.

"However, these technologies have limited success due to their inherent limitations in lack of clarity in distinguishing driver mutations in pathways from those of passengers," said Pradip K. Majumder, Ph.D., of the division of cancer biology at Mitra Biotech, Bangalore, India.

Majumder and colleagues used a systems biology approach called tumor explant model to distinguish driver mutations, or those that are critical for a tumor's survival, from passenger mutations. This distinction is important for stratifying patients for current treatments and for developing novel rational combinations of anticancer agents.

The researchers collected fresh tumor tissue from 22 patients with head and neck cancers and conducted ex-vivo explant experiments. They were able to identify responders to rapamycin, an mTOR inhibitor. However, a majority of the tumor samples did not have an antitumor effect after treatment with the mTOR inhibitor, possibly because rapamycin is known to activate the AKT pathway.

To combat the AKT pathway activation, Majumder and colleagues treated the tumor samples with rapamycin in combination with an AKT inhibitor. Rapamycin-induced AKT activation was reversed, but a subset of patients still failed to respond.

"While few tumors are dependent on only mTOR, others are dependent on both mTOR and AKT," Majumder said. "However, a majority of the mTOR pathway-activated tumors seemed to not be dependent on this axis for survival or maintenance."

Targeted phosphoproteomic characterization of tumors resistant to dual AKT/mTOR inhibitors showed that multiple pathways were supporting the tumors' proliferation and survival and likely responsible for treatment resistance. This approach of combining ex vivo functional analyses with molecular profiling could potentially be used to stratify patients for appropriate combination therapy, according to Majumder.

"A majority of anticancer drugs fail in the phase II efficacy stage of clinical development due to a lack of technologies to identify and appropriately stratify patients according to their tumor pathway dependence," Majumder said. "Using this approach, researchers may be able to develop a translational tool for further clinical development of novel anticancer drugs."

Amazon posts $21.27 billion in 2012 Q4 revenues, makes tinier profit of $97 million

It's still the same old story, really. Amazon pulls in revenues equal to a small nation's GDP and makes a small profit for itself in the process. In this case, particularly small. Jeff Bezos' little company that could has posted fourth-quarter turnover of $21.27 billion, a 22 percent increase, but a net profit of $97 million that's down 45 percent from a year earlier. The discrepancy is attributed to a shift in reading habits that Bezos claims the company was expecting. Kindle downloads have been growing quickly, but old-fashioned paper book sales grew just 5 percent in December -- the lowest in company history, Bezos says. That's not surprising when you look at Amazon's bestseller charts, as the Kindle Fire HD and three other Kindle devices led the ranks. Most of the concern centers on the future. Amazon expects its operating income to dip from $405 million to anywhere between a $285 million loss and a $65 million profit, which doesn't exactly set a high bar for post-holiday performance.

Amazon.com Announces Fourth Quarter Sales up 22% to $21.27 Billion
Operating income up 56% year-over-year - above high end of guidance

SEATTLE, Jan 29, 2013 (BUSINESS WIRE) -- Amazon.com, Inc. AMZN +11.16% today announced financial results for its fourth quarter ended December 31, 2012.

Operating cash flow increased 7% to $4.18 billion for the trailing twelve months, compared with $3.90 billion for the trailing twelve months ended December 31, 2011. Free cash flow decreased 81% to $395 million for the trailing twelve months, compared with $2.09 billion for the trailing twelve months ended December 31, 2011. Free cash flow for the trailing twelve months ended December 31, 2012 includes fourth quarter cash outflows for purchases of corporate office space and property in Seattle, Washington, of $1.4 billion.

Common shares outstanding plus shares underlying stock-based awards totaled 470 million on December 31, 2012, compared with 468 million one year ago.

Net sales increased 22% to $21.27 billion in the fourth quarter, compared with $17.43 billion in fourth quarter 2011. Excluding the $178 million unfavorable impact from year-over-year changes in foreign exchange rates throughout the quarter, net sales grew 23% compared with fourth quarter 2011.

Operating income increased 56% to $405 million in the fourth quarter, compared with $260 million in fourth quarter 2011. The favorable impact from year-over-year changes in foreign exchange rates throughout the quarter on operating income was $2 million.

Net income decreased 45% to $97 million in the fourth quarter, or $0.21 per diluted share, compared with $177 million, or $0.38 per diluted share, in fourth quarter 2011.

"After 5 years, eBooks is a multi-billion dollar category for us and growing fast - up approximately 70% last year. In contrast, our physical book sales experienced the lowest December growth rate in our 17 years as a book seller, up just 5%. Full Year 2012

Net sales increased 27% to $61.09 billion, compared with $48.08 billion in 2011. Excluding the $854 million unfavorable impact from year-over-year changes in foreign exchange rates throughout the year, net sales grew 29% compared with 2011.

Operating income decreased 22% to $676 million, compared with $862 million in 2011. The unfavorable impact from year-over-year changes in foreign exchange rates throughout the year on operating income was $14 million.

Net loss was $39 million, or $0.09 per diluted share, compared with net income of $631 million, or $1.37 per diluted share, in 2011.

Highlights

-- For the second year in a row, Amazon's tablet was the most popular item for customers - Kindle Fire HD continued its run as the #1 best-selling, most gifted, and most wished for product across the millions of items available on Amazon worldwide. At year-end, Kindle Fire HD, Kindle Fire, Kindle Paperwhite and Kindle held the top four spots on the Amazon worldwide best seller charts since launch.

-- Amazon announced the launch of AutoRip, a new service that gives customers free MP3 versions of CDs they purchase from Amazon. Additionally, customers who have purchased AutoRip CDs at any time since Amazon first opened its Music Store in 1998 will find MP3 versions of those albums in their Cloud Player libraries - also automatically and for free.

-- Amazon introduced Kindle FreeTime Unlimited, bringing together for the first time all of the types of content kids and parents love - books, games, educational apps, movies and TV shows - into one simple, unlimited, easy-to-use service for kids ages 3-8.

-- Amazon's digital media selection has grown to over 23 million movies, TV shows, songs, magazines, books, audiobooks, and popular apps and games in 2012, an increase from 19 million at year-end 2011.

-- Amazon.com announced new licensing agreements with Turner Broadcasting, Warner Bros. Domestic Television Distribution, and A+E Networks, for popular television series including Falling Skies, The Closer, Pawn Stars, Storage Wars, and Dance Moms, expanding its catalog of title offerings for Prime Instant Video to more than 36,000 movies and television episodes.

-- Amazon launched Kindle Stores for Brazil, Canada, China, and Japan, with a large selection of the most popular books, including thousands of local-language books.

-- Amazon announced that 23 KDP authors each sold over 250,000 copies of their books in 2012, and that over 500 KDP Select books have reached the top 100 Kindle best seller lists around the world.

-- Amazon announced that for the eighth consecutive year, the company ranks #1 in customer satisfaction during the holiday shopping season according to the ForeSee annual Holiday E-Retail Satisfaction Index. ForeSee surveyed over 24,000 customers between Thanksgiving and Christmas, asking them to rate their satisfaction with the top 100 retailers. For the second year in a row, Amazon's score of 88 is the highest ever attained by any retailer in the study.

-- Amazon Web Services (AWS) announced the launch of its newest Asia Pacific Region in Sydney, Australia, now available for multiple services including Amazon Elastic Compute Cloud (EC2), Amazon Simple Storage Service (S3), and Amazon Relational Database Service (RDS). Sydney joins Singapore and Tokyo as the third Region in Asia Pacific and the ninth Region worldwide.

-- AWS announced that SAP Business Suite is now certified to run on the AWS cloud platform. Enterprises running SAP Business Suite can now leverage the on-demand, pay as you go AWS platform to support thousands of concurrent users in production without making costly capital expenditures for their underlying infrastructure. AWS also announced that SAP HANA, SAP's in-memory database and platform, is certified to run on AWS and is available for purchase via AWS Marketplace.

-- AWS continued its rapid pace of innovation by launching 159 new services and features in 2012. This is nearly double the services and features launched in 2011.

Florida women frighten off intruder by chanting ?Jesus?

Derick Lee, after being arrested by police (Lake City Police Department)If you ask the 15 women inside Jacquie Hagler?s house what happened, they?ll tell you it?s simple: Jesus scared a would be thief out of the Florida woman?s home.

At first, those gathered at Hagler?s house for a jewelry party thought the intruder was simply part of an elaborate gag, using a ?water gun? to tease the Florida women.

"It's only a water gun," one attendee reportedly said, while brushing away the firearm allegedly brandished by Derick Lee, who entered the home wearing a ski mask and bandana across his face.

Witnesses say Lee then held the gun to the woman?s head and announced, "I'm not joking, I'm going to shoot someone, give me your money." He even showed the women some of the bullets loaded into his gun before they could be convinced the robbery attempt was real.

But what Lee didn?t know was that he was outgunned by the jewelry party attendees ? at least spiritually speaking.

"When I realized what was going on, I stood up and said, 'In the name of Jesus, get out of my house now,'? Hagler told WJXT-TV. And he said, 'I'm going to shoot someone.' And I said it again, real boldly," Hagler continued. "Everybody started chanting, 'Jesus, Jesus, Jesus,' and he did a quick scan of the room, and ran out the door as fast as he could go."

Lee, 24, was arrested Friday night at his home and identified by several of the jewelry party attendees during a police photo lineup. He?s currently being held on a $200,000 bond.

I believe he saw angels,? Hagler said in a separate interview with the Christian Post. ?I think he saw who was on our side, and he just turned around. The look on his face was just, like, astonishment. He was totally captivated by whatever he saw. He just turned around and ran out the door.?

Obama lauds Clinton as she prepares to leave

WASHINGTON (AP) ? President Barack Obama lauded Secretary of State Hillary Rodham Clinton as one of his closest advisers and said their shared vision for America's role in the world persuaded his one-time rival ? and potential successor ? to be his top diplomat while he dealt with the shattered economy at home.

During a joint interview that aired Sunday, Obama and Clinton chuckled as they described their partnership and stoked speculation that Obama may prefer Clinton to succeed him in the White House after the 2016 elections. Clinton is leaving Obama's Cabinet soon, and speculation about the former first lady and senator has only grown more intense after a heated appearance last week on Capitol Hill.

Both Obama and Clinton batted away questions about future campaigns, but the joint interview ? the president's first with anyone other than first lady Michelle Obama ? was only likely to increase the fascination with Clinton's future.

"The president and I care deeply about what's going to happen for our country in the future," Clinton said. "And I don't think, you know, either he or I can make predictions about what's going to happen tomorrow or the next year."

Obama, who suggested the joint interview as Clinton prepared her exit from the State Department, lavished praise on his rival for the 2008 Democratic presidential nomination. He called her a friend and an extraordinary talent, and praised "her discipline, her stamina, her thoughtfulness, her ability to project."

It teetered on an endorsement of a 2016 presidential bid that is still an open question. Clinton advisers say she has not made a decision about a run, while Democratic officials suggest Clinton would be an early favorite if she decided to mount another campaign.

Obama and Clinton laughed when asked about the political future.

"You guys in the press are incorrigible," Obama said when pressed on another Clinton presidency. "I was literally inaugurated four days ago. And you're talking about elections four years from now."

The possibility of a presidential campaign for Vice President Joe Biden did not come up during the interview, taped Friday at the White House.

Obama described why he insisted Clinton become his secretary of state.

"She also was already a world figure," Obama said. "To have somebody who could serve as that effective ambassador in her own right without having to earn her stripes, so to speak, on the international stage, I thought, would be hugely important."

It was a job she initially refused. But Obama kept pushing, Clinton said.

"The one thing he did mention was he basically said: 'You know, we've got this major economic crisis that may push us into a depression. I'm not going to be able to do a lot to satisfy the built-up expectations for our role around the world. So you're going to have to get out there and, you know, really represent us while I deal with, you know, the economic catastrophe I inherited."

It's a job she embraced during the last four years. She arrived on the job with a global brand she quickly lent to promoting U.S. interests. In return, the public rewarded her with high approval ratings that could come in handy if she runs in 2016.

But her tenure has had its blemishes. For example, the United States did not directly intervene in the civil war in Syria, where the United Nations says more than 60,000 people have been killed and more than 2 million people have been internally displaced since the start of the conflict in March 2011.

"There are transitions and transformations taking place all around the world. We are not going to be able to control every aspect of every transition and transformation," Obama said, saying his jobs are to protect the United States and engage where the U.S. can make a difference.

In a separate interview with The New Republic, also released Sunday, Obama said, "As I wrestle with those decisions, I am more mindful probably than most of not only our incredible strengths and capabilities, but also our limitations."

On "60 Minutes," he praised Clinton's State Department for helping him sort out what the United States can ? and cannot ? accomplish.

"It has been a great collaboration over the last four years. I'm going to miss her. Wish she was sticking around. But she has logged in so many miles, I can't begrudge her wanting to take it easy for a little bit," Obama said.

It's something of a turnaround from 2007 and 2008, as the two raced through Iowa and New Hampshire and onward. In increasingly bracing language, the two excoriated the other. At one point, a visibly angry Clinton seethed, "Shame on you, Barack Obama."

Obama now jokes about the rivalry.

"Made for tough debates, by the way, because we could never figure out what we were different on," the president said.

Both acknowledged disagreements continue but said they had common goals.

'Hansel & Gretel' nabs $19M, No. 1 at box office

LOS ANGELES (AP) ? "Hansel & Gretel: Witch Hunters" cooked up $19 million in its opening weekend.

Paramount's R-rated action film update on the classic fairytale topped the box office, according to studio estimates Sunday. "Hansel & Gretel" features Jeremy Renner and Gemma Arterton as grown-up renditions of the title characters battling witches with crossbows.

Don Harris, Paramount's president of distribution, blamed icy weather on the East Coast for the film's not-so-bewitching debut.

"We got dinged a little bit with the weather on Friday, but overall we're pleased," said Harris, who added that "Hansel & Gretel" performed solidly internationally, earning $25 million overseas.

Other films opening over the weekend in the U.S. and Canada didn't fare as well. The crime thriller "Parker," starring Jason Statham and Jennifer Lopez, debuted in fifth place with $7 million, while Relativity Media's raunchy ensemble comedy "Movie 43" opened in the seventh spot with $5 million.

Hollywood.com box-office analyst Paul Dergarabedian noted that it was the first time box-office grosses were down over last year after four up weekends.

Universal's supernatural horror film "Mama" starring Jessica Chastain dropped to second place with $12.8 million in its second weekend.

Several best-picture Academy Awards contenders continued to benefit from Oscar buzz, as well as the motion picture academy's decision to move up this year's nomination announcement, giving nominees more time in theaters between the Jan. 10 nominations unveiling and the Feb. 24 ceremony.

"Having an Oscar nomination is like holding a lottery ticket," said Dergarabedian. "It could pay off on Oscar night, but it's already paying big dividends now. All this time between the Oscar nominations and the telecast is prime time for these movies to capitalize on their higher profile."

"Silver Linings Playbook," which is up for eight Academy Awards, came in third place over the weekend with $10 million. The film starring Bradley Cooper and Jennifer Lawrence is in its 11th weekend of release and earned $3 million overseas.

"Zero Dark Thirty," the Osama bin Laden manhunt drama also starring Chastain, dropped to fourth place with $9.8 million. It's competing in five categories at the Academy Awards and nabbed $3.6 million internationally.

"Django Unchained," which is nominated for five Oscars, took in $5 million in sixth place, and the musical "Les Miserables," which is up for eight Academy Awards, earned $3.9 million in the 10th position. It was the fifth weekend for both films. "Django" topped the international chart with $47.9 million in 65 total territories.

Saturday's fire gutted Smart Exports Garment Ltd, just two months after Bangladesh's?worst ever factory blaze killed 112 workers and injured 150 at Tazreen Fashions Ltd, a multi-story garment workshop in Dhaka's Ashulia suburb.

In a joint statement issued after the latest blaze, three organizations asked retailers and brands to sign a fire safety agreement with Bangladesh.

"After more than two decades of the apparel industry knowing about the risks to these workers, nothing substantial has changed," the executive director of the International Labor Rights Forum, Judy Gearhart, said in the statement.

"Brands still keep their audit results secret. They still walk away when it suits them and trade unions are still marginalized, weakening workers' ability to speak up when they are at risk," she added.

The Worker Rights Consortium (WRC) and the Clean Clothes Campaign (CCC) also signed the statement.

Another rights group, the Institute for Global Labour and Human Rights (ILGHR), said on its website it had gained access to the gutted factory and found seven women workers had been crushed to death as employees tried to escape the fire.

Firefighters and police said the cause of the latest blaze was not yet known. Survivors said it could have been caused by an electrical short circuit at the factory on the upper floor of a two-story building in the crowded Mohammadpur area.

Kalpona Akter, executive director of the Bangladesh?Center for Workers Solidarity, told Reuters that two garment factories had subcontracted orders to the factory's owner, Smart Export Garments Ltd.

She said the company was not a member of the Bangladesh?Garments Manufacturers and Exporters Association and had no license from fire prevention or labor bodies.

An official report into the Tazreen blaze in November concluded it was the result of both sabotage and negligence.

Bangladesh?has about 4,500 garment factories and is the world's biggest exporter of clothing after China. Clothing makes up 80 percent of its $24 billion annual exports.

Ice storm descends on Midwest before heading east

Icy weather across parts of the Midwest affected roads and airports, particularly at O'Hare in Chicago, where nearly 200 flights were canceled. The Weather Channel's Mike Seidel reports.

A storm encased the Midwest in glistening ice on Sunday, forcing officials to cancel flights and closing roadways and threatening to tangle the start of the work week as freezing rains headed east.?

Hundreds of churches across Iowa called off Sunday services as sidewalks were turned to sheets of ice by the storm that meteorologists said had covered the Midwest in about a half-inch of ice by midday.?

Flights in and out of Chicago, Minneapolis and St. Louis were grounded on icy runways.?


The National Weather Service issued a freezing rain advisory for Chicago and the surrounding area for Sunday until 9 p.m. local time, when temperatures were expected to warm up enough to make it just rain. Until then, the weather service warned of dangerous conditions for driving and even walking.?

"Pockets of sleet, freezing rain and freezing drizzle are possible farther east late tonight into Monday morning from Buffalo, New York, to New York City, Philadelphia, Washington, D.C., and Roanoke, Virginia," meteorologist Brian Edwards said on Accuweather.com.?

Slick roadways were reported from South Sioux City, Nebraska, to Iowa, where numerous crashes were reported, according to the Iowa Department of Transportation. In Franklin County, Iowa, Interstate 35 was blocked by tractor trailers struggling to get a grip on treacherous surfaces.?

"Instant icing of windshields and roadway surfaces (as well as driveways, sidewalks and parking lots) can be expected in the areas with freezing temperatures," the Iowa DOT said.?

In Missouri, ramps to connecting Interstate 270, which circles the St. Louis area, to Interstate 70 were closed early Sunday morning because of ice, but were later reopened, said Marie Elliott, a spokeswoman for the Missouri Department of Transportation.?

Trademark law basics

Trademark law started out as a way to protect consumers against counterfeit goods back in the 13th century. Then, in the 1870?s the United States and England set up Trademark Departments granting trademark registrations. So, now to get the rights and protection of the trademark laws you have to register your trademark. You can do this in your state, or federally. Federal trademark registration offers the most protection.

The law states that no two trademarks can be confusingly similar. This means that if consumers are confused about the origin of the product, or in other words, who made it, then there are grounds for trademark infringement. Consumer confusion requires similar trademark and similar product. So, for example, it is not trademark infringement for a dental office to call itself Macintosh Dental, even though Macintosh Computers is trademarked. It is possible for them to coexist because consumers are not going to be confused. These two brands represent significantly different products, and so they are not hurting one another by having similar names, or symbols.

In order for something to be a trademark it has to be unique in some way. There are a lot of ways this can happen. With trademark law it is important to understand there is a whole spectrum of types of trademarks. For example, there are fanciful trademarks, which are defined as ?coined? terms that had no meaning before being trademarks. So, this would be big brands like Chevron, Kodak, Starbucks. Then, there are arbitrary trademarks, which are defined as common words used in a unique way so that the word has no relationship to the product. So, for example, Amazon is an online bookstore that has nothing to do with the Amazon. Apple is a computer, not a fruit, etc. Then you have a group called suggestive trademarks, which are trademarks that allude to a quality of the product, such as Mustang for cars, or Playboy, or 7-11 (when it first opened it was open from 7am to 11 pm). Then you get a group of trademarks called descriptive trademarks, such as Vision Center for an eye and vision store, or a domain name that explains what it does, such as Rachaelswriting.com which alludes that Rachael will be writing. The kind of trademark you have will affect the laws, and infringement decisions.

Generic trademarks are harder to get, and are when the term describes a whole class of products.

Once a trademark is registered it is given a whole bunch of rights, so the registration process is not always easy.

Registration grants exclusive rights to use that trademark for that product in America. Because trademark law grants such strong rights, there is a high standard to achieve registration.
Only fanciful, arbitrary, and suggestive trademarks are considered inherently distinctive and initially entitled to registration.
It could take years before you can officially register a descriptive trademark. Descriptive trademarks can achieve registration if they achieve ?secondary meaning.? ?Secondary meaning? occurs when customers come to recognize the particular term as having a second meaning, signifying a particular brand. Such as Frosted Mini Wheats, are not just cereal, but a brand of Kellogg cereal.

This means that if you want to have the protection of trademark law, it is best to go for a suggestive, fanciful, or arbitrary trademark.

Once you have something you want trademarked, you need to get that trademark cleared. To do this, you have to be first, and you can?t be too similar to someone else?s trademark. So, if you have an idea, search relevant databases to see if a similar trademark exists, then register for it, so that you can get it, even if you do not plan to launch the product for six months.

For you to be protected by trademark laws, proper trademark usage must be enforced.

The following is a brief look at proper trademark use:

Always use Trademark as an adjective modifying a noun. Ex: Kleenex facial tissues.
Never use a trademark as a verb or a noun. Ex: You are not XEROXING a copy but photocopying on a XEROX copier, You are not asking to be handed a Kleenex, but a facial tissue of the Kleenex brand
Be aware of how you use your trademark so that ?Genercide? does not happen. For example, genercide happened to THERMOS, CELLOPHANE, and TRAMPOLINE. These are no longer trademarks, but nouns.
Always use the right trademark symbol. TM or SM can be used at any time, to denote that what you are using is a protectable trademark or service mark. However, you may want to check to make sure you are not infringing before you use this mark. r can only be used once the mark has achieved a United States trademark registration.

What is a trademark?

A trademark is a word, symbol, or phrase, used to identify a particular manufacturer or seller?s products and distinguish them from the products of another. Mazda hopes ride a tankful of chicken guts, beef tallow and pork lard to victory at the grueling Rolex 24 endurance race in Daytona over the coming weekend.

No, the maker isn?t sponsored by the local butcher.? It?s powering its new Mazda6 race car with a custom-made fuel blend that starts out with scraps from Tyson Foods. That organic glop has been converted into a special bio-fuel that will stoke the new SkyActiv-D clean diesel engine that will power Mazda?s entry into the new Grand-Am GX Class at the 24-hour race.

?It?s meat packing residue,? explains John Doonan, the director of Mazda?s ambitious motorsports operation.? And the ultimate blend is so clean the Mazda6 race car won?t need particulate filters or any of the other devices used on other diesel-powered race cars.?

Indeed, Mazda is not the only manufacturer that has switched from gasoline or ethanol to diesel power on the track.? Audi has dominated the Le Mans endurance circuit for much of the past decade, in fact, with a series of racers that routinely leave the competition struggling to keep up.??

The new Mazda6 SkyActiv-D racecar will have some big tire tracks to fill, replacing the maker?s successful RX-8 model.? Mazda will also field two new teams starting with the 2013 Rolex 24 Hours of Daytona.? It will lose its two previous teams, including Dempsey Racing, which was owned by actor and motorsports fanatic Patrick Dempsey.The maker gave its racing team a mandate, explains Doonan, ?to use as many production components as possible. The only things we?ve changed are the crankshaft, pistons and connecting rod.?? And with good reason considering the track-tuned SkyActiv-D will be churning out 400 horsepower and 450 lb-ft of torque, about double what a street-legal 2014 diesel-powered Mazda6 will be making when it goes on sale later this year.

It?s a risky move to launch a new car with new teams and drivers but Mazda is hoping it will pay off and put the brand in the spotlight this year.

The maker has been going through plenty of changes everywhere you look.? It has largely wound down a decades-old relationship with Ford Motor Co. and stopped producing the Mazda6 at a plant the two makers jointly operated in suburban Detroit.

Mazda, meanwhile, has established several new ? if more limited ? alliances with Toyota and Fiat.? The Italian maker?s Alfa Romeo division plans to work with Mazda to develop a new sports car that both companies can sell.? Ford Mazda, it will serve as the replacement for its aging Miata 2-seater. Toyota, meanwhile, will base a replacement for its subcompact Yaris off the Mazda3 platform. And Mazda will produce some of the new models for Toyota out of a plant it is currently setting up in Mexico.?

More alliances could follow, according to Mazda CEO Takashi Yamanouchi.? That could help the small Japanese automaker reduce the hefty expense of developing new products.? Not that Mazda is waiting for assistance.? It has been rolling out an assortment of new models, such as the well-reviewed CX-5 crossover.?

It has also introduced a new concept, dubbed SkyActiv, that it claims can compete with the efficiency of rivals? hybrid products. At its heart, SkyActiv is a new approach to powertrain technology but it also entails steps Mazda engineers are taking to improve the overall efficiency of the maker?s vehicles, down to finding ways to reduce the weight of the lugnuts on the wheels of the new Mazda6.

The all-new version of the sedan will be offered with both the new SkyActiv gasoline and diesel powertrains.

Unfortunately for those who might opt for the SkyActiv-D, they?ll likely have a hard time finding the synthetic diesel Mazda will use on the race track. The renewable blend was developed by Dynamic Fuels, a 50/50 joint venture of Tyson Foods and Syntroleum, and it is being produced at a $150 million refinery which opened up near Baton Rouge, Louisiana two years ago.?

Why Tyson? Because the maker has had to find ways to dispose of 1.5 million pounds of chicken, pork and beef products every single day. Now it can avoid the cost of dumping that offal and potential make some money from it.? The refinery is producing about 75 million gallons of synthetic diesel annually and could ramp up to provide even more.

A number of refiners are working to come up with bio-fuels. The most readily available are ethanol blends. They?ve been controversial because, until now, most have used food stocks, such as corn ? though newer, so-called cellulosic production methods can create the alcohol fuel from waste.?

Many of the new bio-diesel blends use waste products ? though a select number of filling stations near San Francisco recently began offering a blend created from algae.

Dynamic Fuels ultimately hopes to begin selling some of its synthetic diesel to the public and is shooting for a $5 a gallon price tag, notes Mazda?s U.S. CEO Jim O?Sullivan.

Some shuttle buses operated by Alamo and National Car Rental are already testing it on the street. And the U.S. Navy is also using the bio-diesel blend on some of its ships.

Those who buy the new Mazda6 with SkyActiv-D will have to settle for conventional, petroleum-based diesel fuel. But the maker is hoping that with a 14.5 gallon tank of distilled guts under its hood, the Mazda6 race car will dominate its field when the flag drops at Daytona on Saturday.

Cold snap causing 'travel nightmares' for Northeast

NEW YORK (Reuters) - Frozen cash machines and canceled classes marked another day of a cold snap gripping large swaths of the United States on Friday, with a winter storm threatening the Northeast's evening commute.

A rapidly moving storm glazed the Midwest and South and headed east, threatening to bring snow and ice to the mid-Atlantic and Northeast for the evening rush hour, forecasters said.

"It's the type of conditions that cause extreme travel nightmares because things just get so slippery," said meteorologist Evan Myers on Accuweather.com.

Because the storm is dumping ice and no more than an inch of snow, it was difficult for plows to clear the roadways, he said.

"It's so cold out that all the anti-skids and things that they use on a highway (are) really not very effective," the meteorologist said.

In upstate New York, authorities considered charging a father who left his 1-year-old son strapped in a car seat for 8 hours while he went to work on Thursday, when temperatures never got above 15 degrees Fahrenheit (minus 9 Celsius).

He had forgotten to drop the child at day care and became aware of the error when his wife called to ask about the child, said Lieutenant Robert Winn of the Colonie Police Department.

"Luckily the car was parked in a spot that received sunlight through the day," said Winn, noting the child was examined at a local hospital and released.

After a week of frigid temperatures in New York City, chilled residents seeking cash for a warming cup of hot cocoa were frustrated to find their assets frozen as some automated teller machines stopped working in the cold.

In Indiana, ice-slickened roadways were blamed for more than 50 crashes, and sections of Interstates 69 and 64 were shut because of accidents, Indiana State Police said.

Treacherous travel conditions in Tennessee, caused by freezing rain, caused pileups on roads and led to canceled flights at Nashville airport. Classes at most schools in the middle of the state were closed or delayed.

In North Carolina, public schools announced early closures in anticipation of worsening weather conditions.

Forecasters said the cold would continue on Saturday and temperatures would start creeping up on Sunday.

State sees six more flu deaths

More than 600 Oklahomans have been hospitalized by flu since Sept. 30, and 71 of those were in the past week.

Fourteen deaths have been reported. Three of those were in Tulsa County, which has the highest number of hospitalizations by far at 188.

Ten of those who died have been older than 65, and the rest were between the ages of 19 and 64.

The number of hospitalizations in the past three weeks in Oklahoma have been between about 130 and 140.

Research firm IDC released the latest numbers from its Worldwide Quarterly Mobile Phone Tracker this week and found that a total of 482.5 million mobile phones were shipped in the fourth quarter of 2012, an increase from 473.4 million in 2011. Smartphones accounted for nearly half, or 45.5%, of all mobile phone shipments, the highest percentage ever. Samsung (005930) and Apple (AAPL) remained the two top vendors with market shares of 29% and 21.8% respectively. The report did include some surprises, however.

?The high-growth smartphone market, though dominated by Samsung and Apple, still presents ample opportunities for challengers,? said Kevin Restivo, senior research analyst with IDC. ?Vendors with unique market advantages, such as lower-cost devices, can rapidly gain market share, especially in emerging markets?

The remaining top five smartphone vendors are very different now, however ? they no longer include LG (006570), HTC (2498) or Motorola, all of which have been replaced by Huawei (002502), Sony (SNE) and ZTE (0763).

Huawei, a company previously known for its telecom equipment, spying scandals and low-end smartphones, is in the midst of a major transition. Rather than focusing on cheap and carrier-branded phones, the Chinese company has begun to compete with high-end manufacturers such as Samsung and Apple with its new flagship devices.

Huawei experienced unprecedented growth in the fourth quarter of 2012 with shipments increasing 89.5% year-over-year for a 4.9% market share. Close on the company?s heels are both Sony and Chinese rival ZTE with 4.5% and 4.3% shares of the market respectively.

?The fact that Huawei and ZTE now find themselves among the Top 5 smartphone vendors marks a significant shift for the global market,? noted Ramon Llamas, research manager with IDC?s Mobile Phone team. ?Both companies have grown volumes by focusing on the mass market, but in recent quarters they have turned their attention toward higher-end devices. In addition, both companies have pushed the envelope in terms of industrial design with larger displays and smaller form factors, as well as innovative applications and experiences.?

49ers' Kaepernick picked football over pitching

SANTA CLARA, Calif. (AP) - Chicago Cubs scout Sam Hughes watches Colin Kaepernick nowadays and still wonders what the strong-armed NFL quarterback might look like on a pitching mound, as a power arm in the pros. It's hard not to, seeing the zip and accuracy on each throw, the competitive fire and fierce focus.

The Cubs never even watched Kaepernick throw a baseball before drafting him in the 43rd round almost four years ago. They did watch him throw a football for Nevada, and decided that college game told them more than enough.

Ultimately, the Cubs just couldn't lure Kaepernick away from his first love: football. Now, he's headed to the Super Bowl to lead the San Francisco 49ers against Baltimore on Feb. 3.

Hughes, the longtime national cross-checker in the Cubs' scouting department, and several others, including then-general manager Jim Hendry, figured they should give it a shot and hope Kaepernick might reconsider.

"Yeah, that wasn't happening," Kaepernick said with a smile Wednesday, shaking his head.

Hughes tried for two weeks to convince Kaepernick, who had made it all but clear he wouldn't sign. He was surprised anybody drafted him at all given he had been so upfront about sticking with football.

But Chicago's NFL sources - Hughes said three different teams - figured Kaepernick would be a late-round pick or even someone who might have to go the route of the Canadian Football League.

That seems so laughable now. The Niners picked Kaepernick in the second round of the 2011 draft, made him the starter midseason this year and now will ask him to carry them all the way to the franchise's sixth championship in what will be just his 10th career NFL start.

"I was looking at this tall, kind of gangly at the time quarterback that was super athletic and had this really long throwing motion," Hughes said. "I was talking to some of my buddies at Reno and said, `Boy, I wonder if this kid's ever played baseball, he's got an arm stroke like a pitcher."'

That sent Hughes on a fun little research project. Kaepernick regularly threw 90 mph in high school, but was now some 40 pounds heavier as a college football player.

He certainly would throw harder.

"So, I was definitely intrigued, bigger, stronger, more athletic," Hughes said. "Colin had no idea we were even considering drafting him. I kind of caught him off guard when I called him after we drafted him. He kind of got a kick out of it and said his phone was ringing off the hook that he'd been drafted by the Cubs. He had no idea."

Then-Nevada coach Chris Ault had the challenge of developing Kaepernick's football motion - and that wasn't an easy task with the QB having been a pitcher.

"His first two years he was a thrower from his pitching days. It was all sidearm," Ault said. "That was a habit we had to break. You could see his throwing motion, timing and touch was there. His senior year I saw the whole package. He was a guy ready for the NFL who could do all things they'd like him to do plus run. Now I look at him with the Niners and Jim and those guys are doing a super job. He has all the throws. What I really enjoy watching is he really learned to put the touch on the ball when he has to."

49ers coach Jim Harbaugh can appreciate the Cubs' attempt to recruit Kaepernick to baseball. He would have tried, too, had he been in their position.

"He's a man for all seasons," Harbaugh said. "Tremendous football player, basketball player, baseball player, a tremendous athlete with a lot of gifts of God. And a tremendous competitive fire, readiness and willingness to compete, to be able to make cool-headed decisions under fire. Who wouldn't want a player like that in baseball or football?"

Or basketball, for that matter.

Kaepernick was a three-sport star at John H. Pitman High in Turlock, a couple of hours east in California's Central Valley.

At 6-foot-4 and about 180 pounds as a high school senior, he went 11-2 with a 1.27 ERA with two no-hitters and 10 complete games - now-retired Pitman coach Mick Tate couldn't remember Wednesday if there was a second, but the quarterback sure knew.

"There were two," Kaepernick said.

Kaepernick batted .313 with 17 RBIs and a .407 on-base percentage. In basketball, he averaged 15.4 points.

"The thing we're most proud of, those who coached him in high school, is we want to make them better people," Tate said. "We didn't have to work very hard to make him a better person."

And those close to Kaepernick had a pretty good idea which way he was headed.

"He was a phenomenal basketball player here," said Philip Sanchez, Kaepernick's high school guidance counselor who remains a close family friend. "Don't forget that. People think of it as just baseball-football, no. He went from football, the very next day he was leading his team in basketball. Then the very next day when basketball ended, now it was time to start pitching. That's rare that you get kids who play three sports these days."

The Cubs figured they had reason to be somewhat optimistic of swaying Kaepernick. They have had success drafting football players, such as pitcher Jeff Samardzija and outfielder Matt Szczur - a pair of former star college wide receivers who picked baseball.

And Kaepernick had tremendous "upside," a common phrase the scouts use to describe potential.

The 49ers saw the same upside. Harbaugh made a midseason switch to him as starter over Alex Smith, the 2005 No. 1 overall draft pick.

"We're not really surprised at his success, because he's always had success," Sanchez said. "I'm just happy that the world has seen the person that we know."

At Pitman, they sure appreciate Kaepernick to this day.

So do the folks in Reno.

During the San Diego State-Nevada basketball game Wednesday night, the plan was for everybody to pose Kaepernick style, flexing the right biceps muscle and kissing it - a new sensation known as "Kaepernicking."

Even the Cubs folks are cheering for him.

"I've followed him since the first time I saw him. He's a very entertaining, fun guy to watch, great athlete, great competitor, very good arm strength, good touch, good feel," Hughes said. "After I drafted him, I talked to him and his father, Rick, four or five times each throughout a two-week period trying to convince him to give baseball a shot. I got to know him through several conversations and since then I've shot him a few text messages - in college after they beat Boise State, which was huge, and after he got drafted by the Niners. A credit to him, I talked to him over a two-week stretch and he didn't know me from Adam and he has returned each one of my text messages. That says a lot about the young man."
